Terms for using HeliQore and accessing the secure transcription workspace.

These terms explain what the service does, what customers are responsible for, and the boundaries that apply to subscriptions, customer data, and professional use.

1. Acceptance Of These Terms

By accessing HeliQore, creating an account, or using the service, you agree to these Terms of Service. If you are using HeliQore on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

Where HeliQore presents these terms during account signup, subscription purchase, or Stripe Checkout, your acceptance at that point forms part of the agreement governing the relevant purchase and service use.

2. What HeliQore Provides

HeliQore is a medical transcription and document-formatting platform. The service is intended to help professional users process uploaded audio, create transcript output, and improve report formatting in medical, specialist, and medico-legal workflows.

3. Not Medical Advice Or Clinical Decision Support

HeliQore is a documentation tool, not a clinical decision-making system, diagnostic tool, or substitute for clinician or transcriptionist review. Users must review generated output before relying on it for patient care, medico-legal reporting, billing, coding, or other professional purposes.

4. Account Responsibilities

  • Keep account credentials secure and do not share access improperly.
  • Provide accurate account and billing information.
  • Use the service only for lawful and authorised workflows.
  • Promptly notify HeliQore if you suspect unauthorised access or a security issue.

5. Customer Data And Upload Authority

You retain responsibility for the content you upload or submit to HeliQore. You must ensure that you have all necessary rights, consents, and authorisations to provide audio, transcripts, names, and other information to the service.

You retain ownership of your customer data. You grant HeliQore a limited right to host, transmit, process, and display that data solely as needed to provide, secure, support, and improve the contracted service operations.

6. Acceptable Use

You must not use HeliQore to:

  • violate laws, privacy obligations, or contractual duties;
  • submit malicious code, attempt unauthorised access, or disrupt the service;
  • use the platform in ways that infringe another person's confidentiality, privacy, or intellectual property rights;
  • misrepresent generated output as final professional work without human review where review is required.

7. Subscriptions, Pricing, And Billing

Pricing is published on heliqore.com and operational billing is managed inside the authenticated app through Stripe-backed workflows. Subscriptions, included usage limits, extra-minute pricing, renewal timing, and any applicable taxes may vary by plan, region, or enterprise agreement.

Unless otherwise agreed in writing, fees are non-refundable except where required by law. By completing a checkout session, the customer agrees to the subscription, billing, renewal, and plan-change terms presented by HeliQore and Stripe for that transaction.

Self-service checkout is intended for standard commercial use of the HeliQore service. If a customer requires a negotiated enterprise agreement, data processing addendum, or Business Associate Agreement, that customer should contact HeliQore before uploading regulated material through the service.

8. Availability And Product Changes

HeliQore may change, improve, suspend, or discontinue features from time to time. We aim to operate the service reliably, but uptime is not guaranteed and maintenance, vendor outages, abuse prevention, or security events may affect availability.

9. Confidentiality And Security

HeliQore treats customer workflow content as confidential and applies operational and technical safeguards designed for health-sensitive transcription workflows. Customers remain responsible for configuring their own internal access, review, and disclosure practices appropriately.

10. Privacy And Data Handling

Our handling of personal information is described in the Privacy Policy. Enterprise customers may also request separate contractual privacy or data-processing terms where appropriate for the workflow and plan.

11. HIPAA / BAA Workflows

A Business Associate Agreement is not created automatically by website use, account signup, or self-service Stripe Checkout. Any HIPAA-sensitive workflow that requires a BAA must be separately approved by HeliQore and covered by a signed written BAA.

12. Intellectual Property

HeliQore retains all rights in the service, software, branding, site content, and underlying platform materials other than customer data. These terms do not transfer ownership of the service to you.

13. Suspension Or Termination

HeliQore may suspend or terminate access if these terms are breached, if use creates security or legal risk, if payment obligations are not met, or if the service is discontinued. You may stop using the service at any time, subject to any active subscription terms and billing commitments.

14. Disclaimers

To the maximum extent permitted by law, HeliQore is provided on an as is and as available basis. We do not warrant that output will be error-free, uninterrupted, or suitable for every workflow, jurisdiction, or compliance requirement.

15. Limitation Of Liability

To the maximum extent permitted by law, HeliQore is not liable for indirect, incidental, special, consequential, or loss-of-profit damages, or for losses arising from customer misuse, inadequate review of generated output, third-party outages, or unauthorised uploads.

Where liability cannot be excluded, it is limited to the amount paid for the affected service period or the re-supply of the relevant service, to the extent permitted by applicable law.

16. Governing Law

Unless a separate written agreement says otherwise, these terms are governed by Australian law. If a mandatory consumer law or enterprise contract applies differently, that law or contract prevails to the extent of the inconsistency.
